Previously, the APC and its candidate filed a petition contesting the declaration of Governor Fintiri as the victor of the gubernatorial election held on March 18, 2023. The petition cited extensive violations of electoral laws and fraudulent voting practices. Additionally, the APC and Binani argued that the Tribunal should validate the announcement made by the then Resident Electoral Commissioner (REC) in the State, Hudu Yunusa Ari, proclaiming her as the election winner in the absence of the Returning Officer.

In response, the PDP and its Adamawa State, Governorship Election, Petitions Tribunal, Verdict, APC, Governor Ahmadu Fintiri, PDP, Aishatu Dahiru Binani, Electoral Law, Fraudulent Practices, Judgment, October 28, 2023candidate, Fintiri, submitted a motion urging the Tribunal to dismiss the case brought by the APC and its candidate.

Binani has emphasized the urgency of delivering a verdict before the suspended INEC REC, Hudu Ari, faces prosecution for alleged illegal declaration. The Adamawa State High Court of Justice has scheduled Ari's arraignment for November 6, 2023.

Ari is facing multiple charges, including the announcement of false election results, breaching his oath of neutrality, disorderly conduct during elections, inciting disturbance, and impersonating a public servant.
